L’effectivité de la directive n° 2014/67/UE par le prisme de ces acteurs

Abstract : The goal of directive n° 2014/67/EU includes improving the implementation of secondment directive n° 96/71/EC. Indeed, the various secondment situations can lead to abuse and to a form of social dumping. In order to fight those phenomena, directive n° 2014/67/EU relies on the member countries and the seconded employees themselves. But whether you place yourself upstream or downstream, therefore from the point of view of the administrative organisation, of the right to information, of sanctions or of possible legal claims, the May 15, 2014 directive is in our opinion, far too restrictive and therefore is disappointing in many respects.
